General Provisions
These Terms and Conditions govern the relationship between FinCo Bunker Terminal Den Helder (hereinafter "the Company") and its clients regarding the supply of marine fuels and related services.
By engaging our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
Services and Pricing
The Company provides bunker supply services through its depot facilities and dedicated bunker vessels. All prices are quoted in the currency specified in the confirmation note and are subject to change without prior notice until an official confirmation is issued.
Prices are exclusive of any applicable taxes, duties, or port charges unless otherwise stated.
Quality and Quantity
The Company warrants that all marine fuels supplied will comply with the specifications stated in the confirmation note and relevant international standards, including ISO 8217.
Quantity determination shall be based on the vessel's calibrated tanks or the bunker vessel's meter readings, as mutually agreed upon prior to delivery.
Delivery and Acceptance
The receiving vessel must be properly prepared to receive bunkers upon the bunker vessel's arrival. Any delays caused by the receiving vessel's unreadiness may result in demurrage charges.
The Master of the receiving vessel or their authorized representative must sign the Bunker Delivery Note upon completion of delivery, acknowledging receipt of the specified quantity and quality of fuel.
Liability and Claims
Any claims regarding quantity must be raised immediately upon completion of delivery, before the bunker vessel departs.
Quality claims must be notified to the Company in writing within 14 days of delivery, accompanied by supporting documentation including representative samples.
